Being arrested and booked at Henrico County Jail West, Chesterfield County Jail, Fairfax County Adult Detention Center, and elsewhere in Virginia can make the beginning of a long and stressful ordeal. Law enforcement can be quick to arrest someone, even without having understood all the facts of the case. Once detained, a judge decides whether the defendant can safely be released on bail.
Entering a not guilty plea initiates the pretrial phase, during which the defense can review the evidence and prepare its strategy to contest the charges. There may be strict bond supervision imposed as a condition of release. As the case moves forward, there are mandatory court hearings, and the prosecution may make a plea bargain offer. A weak prosecutorial case could lead to favorable terms for resolving the charges.
The defense can take steps to cast doubt on the state’s case by challenging witnesses’ credibility, suppressing unlawfully obtained evidence, and offering alternative explanations for what happened. If the prosecution cannot move forward with the current charges, they may reduce or drop them.
Cases are often resolved through plea bargaining, and favorable terms presented by prosecutors, such as reduced charges, can allow the defendant to avoid heavy penalties. Criminal cases are also resolved through trials, although taking a case before a judge or jury can significantly extend a case’s timeline. Driving under the influence and reckless driving are both serious offenses that can lead to a criminal record, the loss of driving privileges, and other serious penalties. Drivers with a blood alcohol content (BAC) of 0.08% or higher are considered to be driving under the influence. Drivers under 21 with any detectable levels of alcohol could also lead to an arrest and criminal charges. In 2022, 27% of all roadway fatalities were tied to drunk driving.
Law enforcement officers throughout Virginia actively monitor for signs of impaired or dangerous driving along major highways, residential roads, and heavily traveled corridors. Drivers accused of operating a vehicle while under the influence of alcohol or drugs may face DUI charges if prosecutors believe their ability to safely operate a vehicle was impaired.
Reckless driving charges can arise from a wide range of driving behaviors, including speeding, racing, aggressive driving, and failing to maintain proper control of a vehicle or truck. These driving behaviors can endanger others and lead to serious collisions. Virginia ranks among the top 10 states for speeding tickets, and anyone driving 20 miles per hour over the speed limit could be charged with reckless driving.
Law enforcement may initiate a stop when they see a driver swerving or driving in a manner that suggests intoxication. After questioning the driver, the police may have the vehicle operator undertake a field sobriety or breathalyzer test. Reckless driving can result from an officer witnessing dangerous roadway behavior. Other cases may result from an investigation involving eyewitness testimony or dashcam footage.
